
What do record low natural gas prices mean for states?

But the boom is over for Wyoming, at least for now. A precipitous drop in the price of natural gas has sent state lawmakers scrambling to make budget cuts. For every 75-cent drop in the price of natural gas, the state loses about $113 million in expected tax revenue, on a budget of just over $3 billion. Over the past two years, natural gas prices have fallen by more than $3. Energy experts see the trend lasting for at least another year. “It’s a very important topic out here,” says Renny MacKay, spokesman for Matt Mead, Wyoming’s Republican governor.
Other states also have seen their revenues related to natural gas production drop. In Oklahoma, the $20 million derived from taxes on natural gas in January came in 16 percent below expectations and 21 percent below last year’s amount. New Mexico and Texas also are seeing drops in revenues related to natural gas, although the pain there, as in Oklahoma, is compensated by surging oil revenues.
Budgets are only one place where historically low natural gas prices are having an impact in states. The pace of drilling, much of it using a controversial practice known as hydraulic fracturing, also is being impacted, as activity shifts away from some states and toward others. An era of cheap natural gas may also pose a challenge to state efforts to boost wind, solar and nuclear power, since natural gas is relatively clean burning for a fossil fuel. As a recent study from the Massachusetts Institute of Technology put it, “Gas-fired power sets a competitive benchmark against which other technologies must compete in a lower carbon environment.”
A vast supply
Multiple forces are colliding to put intense downward pressure on natural gas prices. On the supply side, new discoveries of shale deposits, along with the advent of horizontal drilling and hydraulic fracturing, have unlocked new reserves of natural gas. Some experts predict the U.S. has enough of the fuel to meet energy demands for the next century.
“We don’t have abundant quantities of natural gas,” says Robert Bryce, a fellow at the Center for Energy Policy and the Environment at the Manhattan Institute, a libertarian think-tank. “We have superabundant quantities.”
Meanwhile, demand for natural gas is down, as a result of an unusually mild winter, coupled with the country’s still-slow economic recovery. The price of natural gas is at its lowest level in ten years.
Consumers, of course, aren’t complaining. For some, home heating bills have been slashed nearly in half. But energy executives grimace at what low prices mean for their bottom line. “The price is almost not sustainable,” says Cal Cooper, special projects manager at Houston-based Apache Energy.
As a result, several companies are scaling back natural gas production. That includes Chesapeake Energy, the nation’s second-largest producer, which cited pricing concerns when it announced plans last month to cut production by about 8 percent and to cut drilling activity in half. Nationwide, drilling has fallen 50 percent from its peak in 2008.
While drilling is down in some places, however, it is up in others. Some energy companies are shifting away from drilling for so-called “dry” natural gas in order to increase production of liquid natural gas. This “wet” gas contains chemicals such as propane, helium and butane, which can be sold on their own.
Because of that extra value, experts expect drilling will only increase in Ohio, home to the mostly wet Utica shale formation. That shift could come at the expense of Pennsylvania, whose Marcellus formation yields mostly dry gas within the state’s borders. Several companies, including Chesapeake Energy and Talisman Energy have shifted to wet gas. Talisman announced this week that it will reduce its Marcellus rigs from 10 to three over the course of the year.
Grid troubles in Texas
An abundance of cheap natural gas also will impact electric generation. In Texas, in fact, there are worries that it will produce a power shortage. The Electric Reliability Council of Texas has cited the soft market for natural gas as a reason that Texas could face energy shortages by 2014.
As Donna Nelson, who chairs the Public Utility Commission of Texas, recently explained the situation to state lawmakers, low gas prices have led to low prices for wholesale electricity. And that is making utility companies reluctant to build infrastructure that would help Texas meet the electricity demands of its growing population. In Texas, utilities bear the cost of such upgrades — they don’t pass them to consumers. Cheap electricity may be good for consumers, Nelson says, “but it makes it challenging for the electric industry.”
Mark Zion, executive director of the Texas Public Power Association, isn’t as grim about Texas’ energy future. But he says the current market shows the danger of relying too much on one energy resource. “We’ll see a lot of natural gas generation built in the coming years,” he told lawmakers. “But we need to be careful about putting all our eggs in one basket.”
Some environmentalists are fretting that if natural gas stays cheap for long, it may become harder to justify investments in renewable energy sources such as solar and wind. Already, nuclear energy, which not long ago appeared poised for a comeback, is feeling the impact. There are several reasons why nuclear developments have stalled, but low-price natural gas is one of them. “Nuclear,” says Bryce, “is getting priced out of the market.”
Concerns in Wyoming
In the meantime, some states are looking for their own ways to boost demand for natural gas. Wyoming’s Mead says investing in natural gas-powered turbines or motor vehicles would be one way to do that. As Stateline has reported, Mead was one of ten governors to sign an agreement to replace aging government vehicles with ones that run on compressed natural gas.
But until natural gas prices rise, Mead says the state needs to get tighter on spending. While Wyoming’s economy remains one of the healthiest among states, close to one-third of the state’s revenue comes from the natural gas industry. So when the price of gas fell about 75 cents from December 2011 to January 2012, Mead had to scramble to find $60 million in cuts to the budget he was about to submit to the legislature. “We had to readjust in a hurry,” says Renny MacKay, Mead’s spokesperson.
With prices expected to keep falling, revenue in Wyoming could fall short of projections again. With that in mind, the state’s Joint Appropriations Committee has called for spending cuts of at least 8 percent, and it approved a Mead proposal to set aside $150 million to cover future shortfalls.
“We have to be fiscally conservative now,” Mead recently told reporters, “to make sure that we don’t put ourselves in a hole down the road.”

KY: Medicaid blame gameThe monumental problems that developed when the state shifted its Medicaid administration to three managed care companies last November may not have been inevitable, but they certainly have been painful for health care providers across the commonwealth in the past three months. That’s why state Auditor Adam Edelen correctly responded to complaints about the reimbursement of claims (and the denial of some) by the three companies by sending them letters of inquiry last month. His investigation of CoventryCares, WellCare and Kentucky Spirit is continuing. And in Frankfort, lawmakers have jumped into the debate with questions for both providers and the contractors in public hearings. On Wednesday, officials from the three companies (which administer all Medicaid managed care clients outside of Louisville and 15 surrounding counties) answered questions from the Senate Health and Welfare Committee. During that session, the blame game was in full swing, with the companies — and Republican senators — seeming to give the Beshear administration the lion’s share of criticism for the situation. It is far too early to reach such a conclusion. State Sen. Joe Bowen, R-Owensboro, asked: “You all didn’t have the opportunity for a soft opening, you had a grand opening and more people showed up than you anticipated. I mean is that fair to say?” That grand opening to which he referred was Nov. 1, one week before Gov. Steve Beshear, a Democrat, was re-elected by an overwhelming majority. The final plans for the managed care contracts had been announced by the administration on Oct. 15. WellCare president Mike Minor responded by saying, “I would say there was an extreme urgency between Oct. 15 and Nov. 1 to get contracts done, and it was terrific to see the provider community had the urgency to get that done.” The switch to managed care was a responsible move by the Beshear administration, which predicts substantial savings in the $6-billion-per-year Medicaid program. And remember, just three and a half months have passed since the changes took effect, barely time for some of the claims to be processed. Sen. David Givens, R-Greensburg, questioned whether Medicaid officials had waited too long before responding to the complaints of providers. “At what point are you going to lose your patience?” Sen. Givens demanded. Clearly answers aren’t going to come from this sort of partisan exercise. Let’s wait for the auditor’s office to provide some clearer guidance about what went wrong and, more important, how to keep it from continuing. KY: Kentucky firm says it will close if U.S. contract goes to federal prisonersWASHINGTON — A Kentucky company that sells the Air Force as many as 70,000 jackets a year — including the ones presidents wear — said Thursday that it will be put out of business if the federal government adopts a plan to give the work to federal prisoners. Ashland Sales and Service, in Olive Hill, employs 100 people to make the Air Force jackets under a five-year, $20 million contract. Every member of the Air Force gets one of the jackets, and presidents, including Barack Obama, have worn them while flying aboard Air Force One. “It’s not a done deal yet,” said Ashland Sales President Michael Mansh, who is enlisting help from Senate Minority Leader Mitch McConnell, R-Ky., and Sen. Rand Paul, R-Ky., to persuade the Defense Department to reverse course. But if the government proceeds as planned, the 50-year-old company would fold, Mansh said in an interview. McConnell issued a statement saying he was “stunned” to learn of the company’s plight. “There are plenty of things prisoners can do to improve our communities that don't involve putting a company that has made Air Force jackets for the past 50 years out of business,” the senator said. “With Kentucky's unemployment still above 9 percent, now is not the time for this administration to start looking for ways to pay convicts to take law-abiding, taxpaying Kentuckians’ jobs,” McConnell added. The Defense Logistics Agency said that after it put out solicitations for a new contract last October, it received a notice that Federal Prison Industries, a self-funded government corporation that provides jobs and training to federal inmates, was interested in the work. “No decision to move the current contract has been made,” said Mimi Schirmacher, spokeswoman for the logistics agency at Fort Belvoir, Va. Under federal law, the agency must determine through market research — which is under way — whether a prison-made item is comparable to products from the private sector, Schirmacher said. Congress requires the government to buy from Federal Prison Industries if a product its inmates make is comparable to products made by private companies, she said. If the federal inmates do not make a comparable product, the law requires that Federal Prison Industries be allowed to compete with companies for the business, according to Schirmacher. KY: Kentucky doctor suspended for allegedly pushing pain pills(Page 2 of 3) No one answered the telephone on Thursday at Accu Health, the clinic formerly known as Lexington Algiatry where Azmat has been working. Records seizedOn Wednesday, law-enforcement officials, including agents of the U.S. Drug Enforcement Administration, the state attorney general’s office and Lexington police officers, executed a federal search warrant at the clinic on Alexandria Drive. They seized records and arrested approximately a half-dozen people, mostly on outstanding warrants. No clinic personnel were taken into custody. DEA officials declined to comment except to acknowledge that the warrant had been served by their agency. DeMoisey, a former licensure-board counsel, said in a phone interview Thursday after the board meeting that Azmat “is anxious to avail himself of the opportunity to defend his practice and will actively defend it, and will proceed to exhaust his remedies both administrative and legal.” DeMoisey also said he thought the board’s decision was “overkill.” Noting that Azmat is, by training, a vascular surgeon, DeMoisey said: “If they have an issue with his efforts in pain management, fine, preclude him from practicing pain management. But to prevent him from practicing medicine altogether is inappropriate.” In November, a licensure-board investigator took possession of additional records at the clinic’s former location on North Broadway, across the street from Whitaker Bank Ballpark. Shortly thereafter, complaints from other tenants at the strip mall where the clinic was located, coupled with pressure from the mall owner, forced it to move. The clinic’s lease on North Broadway was signed by Warren Gold, who ran a pain clinic in Tampa, Fla., that was shut down in 2010 for operating without a license. Gold later pleaded no contest to a misdemeanor charge, but the judgment was “withheld” and he was sentenced to six months’ probation and ordered not to have any involvement with the Tampa clinic during his probationary period. The licensure board’s order Thursday said Gold provided Azmat with an apartment in Lexington and that Azmat had family in Waycross, Ga., where he lived on weekends. KY: House passes bill to raise dropout age to 18(Page 2 of 2) Most states that have increased the dropout age to 18 are not showing improvement, and some are sliding backward, said Rep. Ben Waide, R-Madisonville. Every lawmaker wants students to graduate, “but in states that have tried this, this law doesn’t work,” he said. “This doesn’t solve the problem.” Greer has pushed for the higher dropout age in the past two legislative sessions with support from first lady Jane Beshear and the Kentucky Department of Education. Gov. Steve Beshear has also listed the issue high on his agenda. Greer’s previous dropout bills have included language to strengthen alternative-education programs that would draw out at-risk students from the typical classroom and seek to reinvigorate their commitment to graduating. The language was left out this year, and Greer said the Department of Education is considering ways to improve alternative education through regulatory changes. He also said the rules would not prevent students from graduating early. Last week the Senate passed its version of a dropout bill, which would allow individual school districts to raise the dropout age. Sponsored by Sen. Jack Westwood, R-Erlanger, the measure was paired with another bill to improve career education. Senate Education Committee Chairman Ken Winters, R-Murray, said he is willing to discuss a compromise between the House and Senate positions. The felon voting bill — sponsored by Rep. Jesse Crenshaw, D-Fayette — proposes a ballot amendment to restore voting rights to felons except in cases of treason, intentional killing or bribery after the expiration of probation, a final discharge of parole or the completion of their sentence. Kentucky is one of only four states with a permanent bar on voting after a felony conviction, although people may apply to the governor for a restoration of rights. A 2006 estimate indicated that the change could affect nearly 170,000 people. “The right to vote is one of the most important rights that citizens have,” Crenshaw said Thursday. Society asks criminals to rehabilitate themselves but “we do not welcome them back once they have paid their debt,” he added. The House also passed HB 300, which would require “placement agents” who work with state retirement systems to register as lobbyists and establish term limits for trustees on the Kentucky Retirement Systems board. Rep. Mike Cherry, D-Princeton, the bill’s sponsor, said it addresses many concerns identified in an audit of KRS last year. The bill cleared the House 97-0 and now goes to the Senate. |
